Your Choice Act (for non-violent drug offenses)

The "Your Choice Crime Reform Bill" will help eliminate taxpayer's costs of keeping someone in jail (approx. $32,000 per year).  It keeps a household from losing an income and to help put an end to this constant circle of poverty from occurring with this financial hit to the family. This will help increase graduation rates by keeping both parents in the children's life instead of losing one or both with jail time.  Studies show households with both parent's home have higher graduation rates.  It will allow the defendants to maintain their employment while serving their required community service.  This helps to eliminate the poverty cycle that we see all too often.  This Bill will grant people the opportunity to work off their debt to society by cleaning up public parks, city streets, highways, graffiti, etc instead of just sitting in jail and wasting taxpayer money. 

Level 1- first offense
$500 fine
100 hours community service, additional treatment for drugs or mental health not included in the hours set

Level 2- second offense
$1000 fine
150 hours community service, additional treatment for drugs or mental health not included in the hours set

Level 3- third offense and thereafter
$2000 fine
200 hours community service, additional treatment for drugs or mental health not included in the hours set

A minimum of 15 hours per week must be served as determined by the Judge to circumvent the work schedule of the "prisoner."  If the minimum number of hours required is not met (or missed) or fine is not paid then there will be 45 days jail time under Level 1, 90 days jail time under Level 2, and 120 days jail time under Level 3.  

"Community service" will be determined by the needs of the city in which the law was broken or by the needs of the State.
